LOYALTY PROGRAM

LA MAISON is the JEAN PAUL GAULTIER brand loyalty program, available exclusively on the website https://www.jeanpaulgaultier.com/us/en_US (the “Website”) and operated by PUIG NORTH AMERICA INC in the United States.

These Terms and Conditions explain who we are, how the program works, its tiers and benefits, how the program may be modified or terminated, as well as other important information.

Please read these Terms carefully before joining the program. We recommend that you keep a copy for future reference. You can also view previous versions of the Terms via the dedicated link on the Website.

PUIG NORTH AMERICA INC is a corporation organized under the laws of the State of New York, whose principal office is located at 630 5th Avenue, 32nd Floor, New York, NY 10111 (United States).
Its Tax ID number is 13-1978157.

If you have any questions about the program or your membership, or if you believe there is an error in these Terms, please contact us via the Contact Us page on the Website.

1. 1. Your participation in the program is governed by these Terms, which must be read together with our Privacy Policy, our Cookie Policy and our Terms and Conditions of Use.

1. 2. By participating in the program, you accept these Terms and the above-mentioned policies, which may be amended from time to time.

1. 3. Puig North America may, at any time, cancel, withdraw or modify the program, the benefits or these Terms, provided that members are given reasonable prior notice. The new Terms will take effect immediately upon their publication on the Website. Continuing to participate in the program after their publication constitutes acceptance of these changes. We therefore recommend that you review the Terms regularly. If you do not accept the changes, you must either (i) contact us via the Contact Us page, or (ii) unsubscribe in accordance with Section 4.b.

1. 4. If the program is canceled, members will be given a reasonable period of time to use their accumulated benefits; after this period, they will be lost. In the event of force majeure, the program may be suspended or canceled without notice.

1. 5. The program is strictly for personal use. Any commercial or professional use is strictly prohibited. We reserve the right to determine whether a transaction constitutes commercial use.

• 6. We may suspend or terminate your membership with immediate effect, including in the following cases:
     • Breach of these Terms;
     • Theft or fraudulent behavior in connection with the program;
     • Provision of false or misleading information;
     • Inappropriate, abusive, defamatory, unlawful or offensive behavior toward us or other members.

Anyone aged 18 or over and residing in the United States may join the program.

To do so, simply create a user account on the Website and expressly choose to join the program. When creating your account, certain personal information will be requested (name, gender, date of birth – for birthday offers – and contact details).Your contact details allow us to send you communications relating to the program and its benefits. You represent that the information provided is accurate and up to date.

You can unsubscribe from the loyalty program at any time directly from the My Account page or by contacting us via the Contact Us form.

Once unsubscribed, you will be removed from the program and will no longer be able to access the associated benefits or receive loyalty-related communications.

An account that remains inactive for three (3) consecutive years (no purchase, login or update) will be automatically closed, and all associated points or benefits will be permanently lost.

Points are credited to the Member’s account based on the cumulative amount of purchases made on the Website, in accordance with Section 6.

Points give access to exclusive benefits (the “program benefits”) described in the Loyalty Program section of the Website.

Benefits cannot be combined and are subject to specific conditions stated at the time they are granted.

Points are personal, non-transferable and cannot be pooled between members.

They are credited approximately 20 days after the purchase, once the return period has expired.

Your tier depends on the total amount spent on the Website over the last 12 months, at a rate of $1 = 10 points:

• Tier 0: Ground Floor

This tier is assigned to Members who have joined the program but have not yet accumulated any points over the last 12 months.

• Tier 1: First Floor

This tier is assigned to Members who have accumulated between 1 and 2,249 points over the last 12 months (equivalent to an amount spent of between $1 and $224.99).

• Tier 2: Second Floor

This tier is assigned to Members who have accumulated between 2,250 and 3,499 points over the last 12 months (equivalent to an amount spent of between $225 and $349.99).

• Tier 3: The Haute Suite

This tier is assigned to Members who have accumulated 3,500 points or more over the last 12 months (equivalent to an amount spent of $350 or more).

Tiers are valid for 12 months on a rolling basis: a 12-month period starts from each purchase made by a Member, meaning that each purchase begins a new period during which the Member can reach a given spending tier.

If a Member makes no purchase allowing them to reach a higher tier within a 12-month period, they will be moved down to Tier 0 (Ground Floor).

Members will receive a range of program benefits, which will vary according to the tier reached.
The benefits available for each tier are those shown at any given time in the Loyalty Program section of the Website.

Members can view their available benefits, see which tier they currently belong to and access the Program Terms in the My Account section, where they will find a dynamic dashboard displaying their current status, the rewards catalog and how to progress to the next tier.

In addition to the Program Benefits described in detail in the Loyalty Program section of the Website, the following provisions apply to all Program Benefits:

• Program Benefits may only be used on the Website.
• To use a benefit, the Member must use the code provided directly in the My Account section or enter the code provided in the communications they receive.
• Program Benefits are subject to availability. Puig North America also reserves the right to replace, withdraw, modify or adapt any benefit or the conditions of its use, subject to reasonable notice being given to Members.
• Once a benefit has been used, it cannot be reactivated, unless otherwise stated.
• Program Benefits cannot be used in conjunction with any other offer, promotion or discount code, unless otherwise stated.
• Program Benefits are non-transferable, non-exchangeable and have no monetary value. They cannot be applied to previous purchases.
• Items purchased using a benefit are intended for personal, non-commercial use and may not be resold or marketed in any way.

Where a Member has received a benefit as part of an eligible purchase, the return of the products concerned will only be accepted if the corresponding benefit is also returned.

You can update your personal information at any time in the My Account section of the Website.

Your email address and personal information are used solely for communications relating to the loyalty program.

1. 1. We are responsible for any loss or damage you suffer that is a foreseeable result of our breach of contract or our negligence, but we are not responsible for any loss or damage that is not foreseeable, subject to applicable law. In such circumstances, our sole liability will be to credit your user account in accordance with the Program Benefits set out in these Terms.

1. 2. We do not exclude or limit in any way our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for breach of any obligations implied by law.

1. 3. We reserve the right to remove a Member from the Program and cancel the associated Benefits if the Member engages in any activity that may constitute a breach of these Terms.

1. 4. We are not responsible for any consequences resulting from a failure to communicate with a Member where such failure is due to inaccurate information provided by that Member.

As a consumer, you may have legal rights under applicable federal and state law in relation to services that are not provided with reasonable care and skill.
Information and advice about your legal rights is available from the Federal Trade Commission (FTC) or your state consumer protection office. Nothing in these Terms (or in any of our other policies) affects these legal rights.

a. This agreement is between you and us. No other person shall have any right to enforce any of its terms.

b. We may transfer our rights and obligations under any agreement with you to another organization. We will notify you in writing if this happens. You may not transfer any of your rights or obligations under the agreement without our prior consent.

c. Each of the provisions of these Terms operates separately. If any court or competent authority decides that any of them is unlawful or unenforceable, the remaining provisions will remain in full force and effect.

d. If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in exercising a right, this will not mean that you do not have to do those things or that we have waived that right. If we do waive a breach by you, we will only do so in writing, and that will not mean that we will automatically waive any later breach.

e. Without prejudice to your rights under applicable law, these Terms are governed by and construed in accordance with the laws of the state in which you reside, excluding the application of the United Nations Convention on Contracts for the International Sale of Goods.

f. The parties agree to submit any dispute to the jurisdiction of the courts of the state in which you reside.
